By purchasing, downloading, installing, or using any product offered by The Algomist ("we," "us," or "our"), including the TFC indicator, LSR indicator, Setup Radar, or any bundled package (collectively, the "Products"), you ("Subscriber") agree to be bound by these Terms of Service. If you do not agree, do not use the Products.
The Products are technical analysis tools designed to run within the TradingView platform. They display calculated values, visual overlays, and scoring systems based on publicly available market data. The Products are informational and educational tools only. They do not place trades, access brokerage accounts, manage funds, or execute any transactions on your behalf.
Nothing provided by The Algomist — including the Products, website content, documentation, community discussions, social media posts, or any other communication — constitutes financial advice, investment advice, trading advice, or any other form of professional advice. All content is provided for informational and educational purposes only.
We are not a registered investment adviser, broker-dealer, financial analyst, or financial planner. We do not hold any professional licenses related to financial or investment advisory services.
Past performance of any trading strategy, indicator signal, or backtested result does not guarantee future results. Trading stocks, options, and other financial instruments involves substantial risk of loss and is not suitable for every investor. You acknowledge that markets are inherently unpredictable, examples and backtests are illustrative only, you may lose some or all of your invested capital, and you are solely responsible for your own trading decisions.
You are solely responsible for evaluating any information, signal, score, or output generated by the Products and for making your own independent trading decisions. Any trades you place based on information from the Products are made at your own risk and discretion. You should consult with a qualified financial professional before making any investment decisions.
Products are sold as recurring subscriptions through our payment processor. You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods.
Upon payment, you receive a personal, non-transferable, non-exclusive license to use the Products on your own TradingView account. You may not redistribute, resell, share access to, reverse-engineer, decompile, or create derivative works from the Products. One subscription = one TradingView account. Sharing access or credentials may result in immediate termination without refund.
All Products, including Pine Script source code, indicator logic, visual designs, documentation, and branding, are the intellectual property of The Algomist and are protected by applicable copyright and trade secret laws.
The Products depend on third-party platforms (TradingView, data providers) over which we have no control. We do not guarantee uninterrupted access and are not liable for any losses resulting from third-party service disruptions.
To the maximum extent permitted by law, The Algomist shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages — including loss of profits, trading losses, data loss, or business interruption — arising out of your use of the Products, regardless of the theory of liability. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
You agree to indemnify and hold harmless The Algomist from any claims, damages, losses, or expenses arising from your use of the Products, your trading activities, or your violation of these Terms.
We reserve the right to modify these Terms at any time. Updated terms will be posted on this page with a revised date. Continued use of the Products after changes are posted constitutes acceptance.
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
